Welcome to the Kepler Dealer website. By accessing or using our website, you agree to comply with and be bound by the following terms and conditions. These terms govern your use of our site and services, so please read them carefully. Your continued use of the site constitutes your acceptance of these terms.

1. General Use of the Website

Open Access: Our website is available to the public, and you do not need to create an account to browse or request quotes. Users who wish to request a quote must provide certain personal information, including their name, email address, and phone number. By submitting this information, you consent to its use as outlined in these terms. Prohibited Activities: To protect the integrity and functionality of our website and the services we provide, the following activities are strictly prohibited:

• Submitting False or Spam Quotes: Users must provide accurate and truthful information when requesting quotes. Any attempts to submit false, misleading, or spam quotes will result in immediate termination of access to our site.
• Unauthorized Commercial Use: Users are prohibited from using our website to filter or submit quotes on behalf of third parties in an attempt to access our dealer network for unauthorized commercial purposes.

Any breach of this provision will result in legal action, and users found in violation will be held fully liable for any damages incurred.

Intellectual Property: All content on this website, including text, images, logos, and other materials, is the exclusive property of Kepler Dealer. Unauthorized use, reproduction, distribution, or modification of any content is strictly prohibited. This applies to all users, including our dealers. Any dealer found using our content without explicit permission will face legal action. Kepler Dealer reserves the right to pursue all available legal remedies to protect our intellectual property.

2. Quotes and Dealer Responsibility

Non-Binding Quotes: Quotes provided through our website are non-binding and serve as an initial estimate based on the information provided by the user. Prices may vary and are ultimately determined by the dealer. Kepler Dealer does not guarantee the accuracy of the quotes provided and is not responsible for any discrepancies between the initial quote and the final pricing. Dealer Independence: Once a quote is forwarded to the relevant Kepler Dealer, our involvement ends. Kepler Dealer serves solely as a platform for connecting users with independent dealers. These dealers operate independently of Kepler Dealer, and we have no control over their actions, pricing, or the quality of their work. It is the sole responsibility of the dealer to manage all aspects of the service, including pricing, quality, and any warranties. Customer Acknowledgment: By using our website, you explicitly acknowledge and agree to the following:

• Kepler Dealer is Not a Party to Transactions: Kepler Dealer is not involved in the transaction between you and the dealer beyond the initial forwarding of your quote request. We do not endorse, guarantee, or assume any responsibility for the services provided by the dealer.
• No Liability for Dealer Actions: Kepler Dealer is not liable for any damages, defects, or issues related to the services provided by the dealer. This includes, but is not limited to, any damage to your vehicle, unsatisfactory work, or breaches of warranty. All claims, disputes, and legal actions must be directed to the dealer.
• Independence of Dealers: Dealers in our network are independent entities and are not employees, agents, or representatives of Kepler Dealer. We do not control or oversee their operations, and any issues arising from their services are solely between the user and the dealer.

Warranties and Guarantees: All warranties, guarantees, and other terms related to the quality and performance of the services provided are exclusively between you and the dealer. Kepler Dealer does not offer any warranties or guarantees and disclaims all responsibility for the work performed by the dealers in our network.

3. SMS/Text Message Terms

Text Message Service: Kepler dealers may send you transactional SMS text messages using their registered business phone number if you have provided your phone number and consented to receive them. By providing consent, you agree to the following terms: Types of Messages: Text messages sent through our platform are strictly transactional and may include:

• Appointment reminders and confirmations
• Quote follow-ups and expiration notices
• Service status updates

Message Frequency: Message frequency varies based on your scheduled appointments and interactions with Kepler dealers. We do not send marketing or promotional text messages. Costs: Message and data rates may apply depending on your mobile carrier and plan. Kepler is not responsible for any charges incurred from receiving text messages. Consent: You may consent to receive text messages in two ways:

• Online: By entering your phone number and checking the SMS opt-in checkbox on our quote request or appointment booking forms. The checkbox is optional and unchecked by default. The opt-in language displayed reads: “I agree to receive SMS messages from [Dealer Name]. Message and data rates may apply. Reply STOP to unsubscribe.” Links to this Terms & Conditions page and our Privacy Policy are displayed alongside the checkbox.
• Verbally: By providing your phone number and verbal agreement to a Kepler dealer during an in-person visit or phone call. The dealer will record your consent with a timestamp in our CRM system.

In both cases, consent is optional and is not required as a condition of purchase or service. The phone number field on our online forms is optional. Customers who do not provide a phone number or do not check the opt-in checkbox will not receive text messages. Opting Out: You may opt out of receiving text messages at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message you receive. After opting out, you will receive a one-time confirmation message: “You have been unsubscribed and will no longer receive messages. Reply START to re-subscribe.” No further messages will be sent unless you re-subscribe. Opting out of text messages does not affect your ability to use our services. Help: For assistance with text messages, reply HELP to any message. You will receive the following response: “You are receiving messages from [Dealer Name]. For support, contact us at [dealer phone] or visit [dealer website]. Reply STOP to unsubscribe. Msg & data rates may apply.” You may also contact us at contact@keplercoatings.com. Opt-In Confirmation: When you first opt in to receive text messages, you will receive a confirmation message: “You are now opted in to receive messages from [Dealer Name]. Reply HELP for help. Reply STOP to unsubscribe. Msg & data rates may apply.” Carrier Liability: Kepler is not liable for delayed or undelivered messages due to carrier network issues or device incompatibility.

4. Limitation of Liability

Service Availability: Kepler Dealer strives to ensure that our website is available and operational at all times. However, we do not guarantee uninterrupted access, and we are not liable for any downtime, technical issues, or interruptions in service. This includes any losses or damages that may result from the unavailability of our website. Accuracy of Information: While we make every effort to ensure that the information on our website is accurate and up-to-date, we cannot guarantee that all content is free from errors or omissions. Users are responsible for verifying the accuracy of any information before relying on it. Kepler Dealer is not liable for any losses or damages resulting from reliance on inaccurate or incomplete information. Kepler Dealer provides information as a guide only, and it may be outdated or inaccurate. Users must verify legal compliance with local and state laws, and Kepler Dealer holds no responsibility for any legal discrepancies. Dispute Resolution: Kepler Dealer does not engage in mediation, arbitration, or any legal proceedings related to disputes between users and dealers. Our role is strictly limited to forwarding quote requests to the appropriate dealer. All other matters, including disputes, contracts, and legal actions, are the sole responsibility of the dealer and the user. Kepler Dealer will not intervene in any disputes, and we disclaim all liability for issues arising from your interactions with the dealer. Legal Disclaimer: Kepler Dealer acts solely as a facilitator, passing on quote requests to independent dealers. We do not participate in the transaction or service beyond this point, and we are not liable for any legal claims related to the services provided by the dealers. This limitation of liability is protected under applicable law, ensuring that Kepler Dealer’s role is limited to connecting customers with dealers. Any legal actions taken against Kepler Dealer in violation of this disclaimer will be vigorously defended.

6. Changes to Terms and Conditions

Updates and Notifications: Kepler Dealer reserves the right to update these terms and conditions at any time. Changes will be posted on this page, and we may also notify you via email if necessary. It is your responsibility to review these terms regularly. Your continued use of our website after any changes are made constitutes your acceptance of the updated terms.

7. Termination of Access

Right to Restrict Access: Kepler Dealer reserves the right to restrict, suspend, or terminate your access to our website or dealer network at our discretion, without notice, if we believe you have violated these terms. This includes, but is not limited to, submitting false or spam quotes, engaging in unauthorized commercial use, or attempting to extract data from our website using automated methods. Dealer Access Restriction: Kepler Dealer also reserves the right to restrict or terminate access to our dealer network if we believe a dealer is in violation of these terms or is engaging in activities that harm the integrity of our network or the user experience.

8. Communication

However, please note that Kepler Dealer has ZERO control over the services provided by the dealers, and any inquiries related to the work performed should be directed to the dealer. We will not mediate or intervene in any disputes, and we disclaim all responsibility for issues related to the dealer’s services. Independence of Dealers: Kepler Dealer is not a franchise, and we do not control the actions, pricing, or services of the independent dealers in our network. We merely provide a platform for customers to connect with dealers. All skills, craftsmanship, warranties, and responsibilities lie solely with the dealer, and Kepler Dealer is not involved in any way beyond the initial connection. Any attempt to hold Kepler Dealer responsible for the actions or services of the dealers will be vigorously defended, as we are not liable for these independent entities.

9. Miscellaneous Provisions

Third-Party Services: While we do not process payments or cross networks, please be aware that our website may utilize third-party services for tracking, analytics, or other purposes. These services operate independently of Kepler Dealer, and we are not responsible for their actions or policies. We encourage users to review the privacy policies and terms of these third-party services. Compliance and Legal Advice: The information provided on our website is intended as a general guide and should not be relied upon as a substitute for professional legal advice. Users are responsible for ensuring their own compliance with applicable laws and regulations. SMS/Text Message Terms

When you provide your phone number, Global Tint may send you helpful text messages about your appointment, quote, or service.

What you’ll receive: Appointment reminders and confirmations, quote and invoice updates, and service status notifications. We only send messages related to your booking — no marketing or promotional texts.

Frequency: Message frequency varies based on your appointments and requests.

Cost: Global Tint does not charge for texts. Standard message and data rates from your mobile carrier may apply, the same as any other text message.

Your choice: Providing your phone number is optional and constitutes your consent to receive service-related text messages. Consent is not a condition of any purchase and is not required to use our services. You can opt out at any time by replying STOP. Reply HELP for assistance.

Data sharing: Text messaging opt-in data and consent will not be sold, shared, or rented to third parties or affiliates for their marketing or promotional purposes.

Carrier Liability: Global Tint is not responsible for delayed or undelivered messages due to carrier network issues.
